It has been confirmed that the minimum requirements established by the IRM regarding the existence of a forum have been met.
Various participatory spaces have been fostered throughout the co-creation process of the II Plan, primarily through two in-person meetings and a final accountability session. Additionally, various pre-existing coordination and collaboration mechanisms have been leveraged, which, as reflected on page 10 of the II Plan document, have been placed at its service. In this regard, it is important to highlight the role played by the Citizen Participation Council of the Valencian Community, around which the participatory process has revolved. This body includes the most relevant associations in the Valencian Community, including those representing vulnerable or marginalized groups.
Furthermore, the II Plan explicitly establishes the creation of:

  • A Steering Group, in which the Directorate-General for Transparency and Participation, the three Provincial Councils, and the Valencian Federation of Municipalities and Provinces will be represented. This Steering Group will hold regular biannual meetings.
  •  Working Groups for the development of commitments, with the participation of all relevant stakeholders (as detailed in the description of each commitment). Each Working Group will define its own meeting schedule.
  • An Open Forum for monitoring and evaluation, in which all actors who have participated or will participate in the process will be invited. This Forum will hold annual meetings.

Additionally, the II Plan proposes a comprehensive monitoring and evaluation plan that enhances the OGP monitoring system, aligning with the recommendations from the final evaluation of the I Action Plan. Should the creation of these groups and the implementation of the monitoring and evaluation plan be confirmed, it can be asserted that, in addition to meeting the minimum required standards, a forum exists in accordance with the standards set by the IRM.

1.2 Is the forum multi-stakeholder?

The co-creation spaces promoted have met the minimum requirements to achieve the level of participation required by the IRM by including both governmental and non-governmental representatives and, in particular, by enabling the participation of civil society and its various stakeholders.

In this regard, the existing coordination and collaboration mechanisms that have been leveraged for the Second Plan include:

  •  Within the Generalitat, the Technical Coordination Commission on Transparency.
  •  The existing inter-institutional collaboration framework with the three Provincial Councils and the Valencian Federation of Municipalities and Provinces (FVMP) through the Valencian Alliance for Open Government.
  •  The Municipal Network for Open Government of the Valencian Community.
  • Collaboration agreements with public universities to promote research and training activities in Open Government.
  • The aforementioned Citizen Participation Council of the Valencian Community.

Additionally, it is important to highlight that participation in the proposed spaces has not been restricted to individuals and entities already part of the mentioned networks or bodies. The co-creation process and its respective calls for participation have been widely disseminated, ensuring that any interested individual could take part. As a result of this process, the participation of governmental and non-governmental actors, as well as civil society, has been effectively facilitated, making it a fully transparent process with maximum traceability.

1.3 Does the forum hold at least one meeting with civil society and non-governmental stakeholders during the co-creation of the action plan?

From a regularity perspective, the minimum requirements established by the IRM for achieving the necessary level of participation in the co-creation process of the action plan have been met. Throughout the process, 2 in-person meetings and 1 final accountability session have been held, with ample evidence available on the Transparency website of the GVA:

• First in-person participatory meeting (November 27, Valencia), aimed at defining the list of commitments that will form the II Action Plan.
• Second in-person participatory meeting (December 11, Valencia), aimed at characterizing the defined commitments.
• Day of accountability and presentation of the II Open Government Action Plan 2024-2027 (April 23, Valencia).

Additionally, the II Action Plan document states that 8 bilateral meetings were held with stakeholders to specify their involvement. Although the occurrence of these meetings is not in question, the only evidence available to the monitoring entity regarding their realization is this mention in the Plan.

in co-creation

2.1 Does the government maintain a Local OGP website or webpage on a government website where information on the OGP Local process (co-creation and implementation) is proactively published?

Currently, there are two websites through which the local government publishes information about the OGP process. Both are integrated into separate pages on the local government’s own websites: the first is included on the GVA Oberta website, and the second on GVA Participa, which are the transparency and participation portals, respectively, of the Generalitat Valenciana.

Both websites are available online with no access barriers (neither requires a password or credentials for access); both feature information about the local OGP process, complete in the case of the I Action Plan and up to the point of progress made thus far in the II Action Plan process; and in both cases, the information is published proactively or regularly, as the most recent content added includes the II Action Plan itself and the Resolution of 21/05/2024 by the Director-General of Transparency and Participation, which approves the Plan.

The review of both websites shows that, as suggested in the final evaluation of the I Action Plan, the presentation of information follows a clearer structure. On the other hand, accessing the two websites via direct links is straightforward, but if accessed through the homepages of GVA Oberta or GVA Participa, the hyperlink to the OGP space is not easy to find, as was noted in the case of the I Action Plan.

2.2 Did the government provide information to stakeholders in advance to facilitate informed and prepared participation in the co-creation process?

The local government shared relevant information for the development of the action plan with government and civil society actors prior to the scheduled co-creation activities, in order to promote informed and prepared participation.

At the beginning of the OGP process, the technical team of the Conselleria prepared a framework document that served as the starting point for the participatory co-creation process of the plan. In addition to this initial contextualization document, a presentation video of the participatory process was launched, along with a form to propose transformative commitments or projects for analysis at the first participatory meeting.

Additionally, various communication and dissemination actions were carried out to inform the public about the opportunity to join the process, through press releases, social media posts, and other channels.

As mentioned in previous sections, the local government prepared a contextualization document for the first in-person meeting. Based on this, a working document was developed for the second meeting, which included information related to the commitments selected during the first meeting, thereby providing feedback to stakeholders in the co-creation process and informing them about the contributions of the participants. (This working document for the second meeting has not been published on the website, which should be addressed). This information was further supplemented during the final feedback session, where the final commitments were presented, along with the strategic lines of Transparency, Participation, and Democratic Quality 2023/2027, which incorporated many of the proposals arising from the working meetings that did not result in commitments for the II Plan. This was expressed by the Director-General of Transparency and Participation during the feedback session, as can be verified in the recording of the activity.

2.5 Was there an iterative dialogue and shared ownership between government and non-governmental stakeholders during the decision making process, including setting the agenda?

The local government, civil society organizations, and other non-governmental stakeholders worked collaboratively to establish the agenda and determine the final selection of commitments and their milestones.

The various scheduled sessions aimed to identify issues or thematic priorities for the development of commitments for the action plan. Participatory dynamics were carried out, where the facilitative role of the external organization was essential in achieving this objective, ensuring the balanced participation of all registered stakeholders in the working groups and the collection of all contributions made.

The final selection of commitments was made after all participation spaces had closed, based on the systematization of all the information collected by the working group of the Conselleria. The government’s commitment to include the non-selected proposals in the strategic lines of Transparency, Participation, and Democratic Quality 2023/2027 can be considered an indication of the willingness to value the iterative dialogue established in this process.

The document itself includes a list of the 39 participating citizen entities, which represent civil society organizations from very different sectors, some of which are representatives of vulnerable or marginalized groups. This reflects inclusivity and diversity in terms of the represented entities, though it is somewhat limited as these types of entities represent a minority in comparison to the total number.

On the other hand, this monitoring entity only has concrete evidence of the registration and participation data from the first in-person meeting, but not from the second. It would be valuable to obtain these details and additional information about the specific individuals attending the meetings (age, gender, origin, territorial scope in which the entity operates, etc.) in order to better assess the level of inclusivity and diversity of the participants in the process.

Institutionalize a Municipal Governance Network of the Comunitat Valenciana and create a network of participatory spaces

1.1 Is the commitment verifiable?

The main objective of the Commitment is the public participation and inclusion of municipal entities, as it seeks to expand and strengthen the Municipal Governance Network of the Valencian Community, which is still in its initial phase. Additionally, its second objective aims at the transfer of value between the results obtained concerning this network and the participatory spaces created, as well as the Citizen Participation Council of the Valencian Community, an entity with a well-established track record in our territory.

Therefore, we can affirm that the OGP values demonstrated in this Commitment are related to transparency and accountability, as well as public participation and inclusion.

The Commitment represents a continuation of the Valencian regional institution’s intention to build a multi-level institutional space linked to governance, following the path of the previous Municipal Participatory Governance Network. The network’s trajectory continues with the objective of growing and consolidating itself as a reference space for the meeting, training, and best practices of municipal entities.

The creation of a governance network, as proposed in Commitment, aims at the ultimate -potential- objective of institutionally weaving together the actions of various municipal, provincial, and regional actors around governance. This is a major challenge that would position the Valencian Community as a leading territory in matters of government and administration. Although this horizon is still distant, Commitment defines the necessary steps to achieve it.

It is a generic proposal that addresses training, a crucial element in any initial phase, and the usability of the results, yet it does not undertake the task of the actual structuring of the Governance Network content. For this reason, the goal of increasing the number of network members is positive, but without proper oversight and engagement, it could turn into a cosmetic action.

1.5 Are there any recommended changes to the design of the commitment to help improve its implementation?

It would be interesting to define a set of actions that are achievable and executable by municipal entities to accompany their integration into the Network. In other words, the willingness to be part of the Network is positive, but it may not entail any further requirements beyond the integration itself. Similarly, while attendance at specific training is positive and necessary, it places the municipal entity in a passive position within institutional action. Therefore, it would be valuable to propose a range of actions or measures linked to governance, with varying levels of demand, to be carried out by at least one of the requesting or recently integrated institutions, which would demonstrate the commitment and proactivity of the entities in alignment with this initiative.

2 Commitment :

Create and revitalise the Learning Community “You Make Democracy” to generate a participatory culture among students in their 3rd and 4th year of Compulsory Secondary Education (ESO)

2.1 Is the commitment verifiable?

The creation of the Learning Community is further strengthened by institutional visits, a practice that brings democratic abstraction into concrete reality.

It would be interesting to define a set of qualitative indicators for the experience of students, teachers, and the institutions visited or involved in the action. The proposed indicators for monitoring and evaluation are relevant and appropriate, as noted in previous sections. However, there is a lack of qualitative components that would allow for a deeper measurement of the experience. Furthermore, it would be pertinent to design a future evaluation that would enable the traceability of the action, thoughts, or positioning of students over time regarding the Valencian democratic institutions. While it is relevant to measure the impact of actions and public policies, in this specific case, it is essential to assess the transformative potential on the critical and democratic capacity of younger generations.

In this regard, we can affirm that the OGP values most relevant to this commitment are access to public information, accountability, and technology and innovation for transparency and accountability.

The various activities planned for the deployment of the commitment do not represent a paradigm shift compared to previous efforts, as they represent an incremental improvement in the projects aimed at promoting and fostering transparency and accountability among the various actors—both public and private—subject to the transparency regulations in the Valencian Community.

That is, the commitment strengthens a call to civil society to increase its level of involvement and interest in transparency, developing collaboration mechanisms with them and establishing clear communication and dissemination tools that allow all parties to better understand the issue at hand. When we add the improvements in the transparency portals aimed at private entities, we can grasp the continuous improvement approach throughout the process.

It would be interesting to explore how the set of proposed actions to improve transparency within the associative fabric of the Valencian Community could be extrapolated to other actors in the region, or even to other public administrations and the Valencian institutional public sector subject to **Law 1/2022, of April 13, on Transparency and Good Governance of the Valencian Community**.

Additionally, any technological improvements in the design and functionalities planned for the **Transparency Portal for Private Entities** ([TEP Portal] could later be tested—if this has not already been done—on the **GVA Transparency Portal** ([GVA Oberta], ensuring a broader and more cohesive transparency strategy across the region.

The Valencian Community had already initiated actions related to civil society participation in public decision-making, but now, this commitment, titled “Generate a regulatory development to increase the role of organized civil society in the public decision-making processes of the Generalitat,” foresees a series of regulatory changes (specifically Articles 29.2, 30.3, and Final Provision 1a.1 of Law 4/2023 on Citizen Participation and Promoting Associations) to enhance civil society’s role in the Citizen Participation Council.
