Statement from Sanjay Pradhan, CEO of the Open Government Partnership, on Paraguay

Washington, D.C. – As CEO of the Open Government Partnership (OGP), I am deeply concerned about the apprehensions raised by civil society organizations in Paraguay about the potential impact of the “Establishing Control, Transparency, and Accountability of Non-Profit Organizations Act” on their ability to operate freely, and on the fundamental rights of association, expression, and privacy.

While we recognize the importance of enhancing transparency and accountability within the non-profit sector, we urge that any regulatory frameworks be developed in partnership with stakeholders, ensuring they are impartial, transparent, and carefully crafted to avoid unintended restrictions on civil society organizations. As observed in other OGP member countries where similar laws were introduced, excessive requirements and ambiguous provisions may impose undue restrictions on the independence and operations of CSOs, and can lead to arbitrary restrictions that weaken civil society’s role in fostering accountability and serving citizens.

In response to concerns expressed, OGP’s Rapid Response Protocol was triggered to review the situation in line with OGP’s core values. I commend the willingness of both civil society and government representatives from the Executive branch to engage with OGP’s Support Unit on these critical matters.

In the spirit of co-creation central to the OGP model, I encourage all parties to pursue open and constructive dialogue to forge a path forward that protects civil society’s essential role while advancing Paraguay’s open government agenda.

Since joining OGP in 2011, Paraguay has demonstrated a strong commitment to open government principles. The government has worked in close collaboration with civil society to develop five national action plans, enact transparency legislation, and establish forums for government-civil society engagement. These initiatives underscore Paraguay’s longstanding commitment to uphold the fundamental freedoms of expression, association, and participation, as enshrined in the Open Government Declaration.

OGP remains committed to supporting Paraguay in finding solutions that safeguard civic space while achieving transparency goals. We look forward to working closely with all stakeholders to uphold the values that define OGP and Paraguay’s open government journey. OGP stands ready to provide the necessary support to foster dialogue and ensure a robust consultative process, including offering good practices and, if helpful, facilitating engagement from Steering Committee members–representing both government and civil society– who can offer insights and support these efforts.

Any solution developed in partnership with civil society will be better and more lasting than regulations thought up without the impacted stakeholders.

It is good to see the use of the Rapid Response Protocol as a means of addressing and hopefuly resolving this matter.
