The civil society members of Open Government Partnership’s Steering Committee have released a statement on COVID and its risks to open government. The Covid-19 pandemic has led to a global state of emergency, rapidly overburdening governments. Public institutions are under pressure as never before. Protecting lives and livelihoods, sustaining health-care systems and the resetting the economy have rightly become the most pressing priorities for the foreseeable future.
Yet another priority needs to be front and centre: the protection of open, inclusive and accountable governance, with democratic standards and personal rights.
A state of emergency such as this pandemic requires extraordinary measures.
In many cases, these measures have been proportionate and justified. However, in several instances there has been weakening of parliamentary oversight and other vital checks and balances, removal of key watchdog officials, aggressive censorship and pressure on journalists, and the introduction of intrusive and potentially permanent digital surveillance regimes. Many interventions appear to go beyond what is necessary for health and safety, even in a pandemic. And in some instances, measures have been introduced without any clarity on when or how they will be rolled back.
Prior to Covid-19 democracy was already at risk, with trust in government at ever lower levels and civic space under attack. A crisis of this magnitude further threatens democracy through increased political repression, overly zealous strengthening of executive power, and increased corruption.
We have already seen that governments that suppress facts, remove oversight and silence critical voices can escalate the crises and increase hardships. On the contrary, open, honest and inclusive governments are leveraging collective knowledge to improve critical services and create a shared sense of responsibility. This approach creates trust in government actions and empowers citizens to be active participants in the response and recovery.
The world finds itself at a crossroad. We can either address this pandemic in a way that protects or even revives trust, democracy, open and inclusive governance — or we can ignore them and expect a deeper erosion of open governance, one that would be very hard to reverse.
To promote the values that define democracy, we call on governments to undertake the following:
- Secure the independent role of parliaments. Take all possible measures to ensure that parliaments continue to function, that they are engaged in and fully consulted on decisions about the pandemic response, and that they are fully able to play their oversight and control functions;
- Ensure participatory collaboration and oversight. Establish specific, sectoral, participatory mechanisms to draw on the expertise in society and to ensure oversight of decisions affecting health care, rights and freedoms, and the emergency allocation of resources and funds, including short-term response and recovery packages;
- Proactively publish information and data on the coronavirus situation. Publish situational data, analytical models, scientific findings, and reports used in decision making and justifications of decisions. Develop specific proactive publication and open data plans to address the information needs of the public, media, academia, and civil society during the pandemic.
- Make all emergency public procurement transparent. Ensure that information on pandemic response procurement, including emergency procurement, is made public as soon as reasonably possible, preferably on a centralised portal and as open data. Ensure that company registration data is available so that investigative journalists and civil society watchdogs can play their role in exposing fraud and corruption.
- Allow all stakeholders to follow the public money. Ensure enhanced transparency of public funds related to all dimensions of the pandemic response, including the spending and recovery packages. Structure participatory debate with all sectors of society and business over economic measures.
- Maintain access to information laws. Take specific measures to maintain the functioning of access to information laws and timeframes for responding during the crisis. Where official capacity is limited, prioritise requests related to the current situation, either answering requests and/or proactively publishing responses to requests on a dedicated website.
- Guarantee and respect freedom of expression. Uphold media freedoms and the rights of journalists to seek and disseminate information, including the freedom of movement of journalists. The free flow of information, including on the internet, should be protected, and any measures to counter false information should be done in ways that do not limit free speech.
- Strengthen whistleblower protections. Commit to protecting whistleblowers who come forward in the public interest to expose problems, shortages, fraud, and corruption in public procurement and in the use of funds dedicated to pandemic responses;
- Protect privacy in all tracking. Ensure that any digital tracking and surveillance used to protect health is time-bound and periodically reviewed, is subject to continuous specialist and civil society oversight to protect privacy, and that there is full transparency on use of the data.
- Sustain ongoing Open Government Partnership processes. It is absolutely essential to maintain, to the extent possible, ongoing initiatives to secure and advance open government. Should there be a need to restructure Action Plans in line with the priorities outlined above, this should always be done after full consultation with civil society.
We call upon inter-governmental organisations to:
- Keep track and raise red flags. It is critical to monitor developments in the realm of governance and democracy, and to point to setbacks that are disproportionate to the crisis.
- Find the resources. Secure and mobilise resources to ensure swift and unequivocal responses to protect human rights and democratic standards, including civic space, freedom of expression, and open government.
- Pursue multilateralism and collaboration mechanisms. When it comes to lives, livelihoods, democracy, and economic rebuilding, begin a race to the top that lifts the many.
We call upon donors to:
- Make funding matter: While responding to the needs created by the pandemic, boost efforts to protect the core pillars of open and democratic societies. This should include supporting civil society organisations and investigative journalists working on transparency, the right of access to information, open data, freedom of expression, anti-corruption, and participation.
It is only by defending and strengthening open government that, during the response and recovery from the Covid-19 crisis , we will be able to revitalise global democracy and bring about more just, equal and cohesive societies.

Los miembros de la sociedad civil del Comité Directivo de Open Government Partnership han publicado un comunicado sobre COVID y sus riesgos para abrir un gobierno. Centrada en los valores democráticos, la declaración es un llamado a la acción a gobiernos, donantes y organizaciones internacionales. Puede agregar su firma como muestra de preocupación y apoyo a continuación.

La pandemia de COVID-19 ha detonado un estado de emergencia a nivel global y ha sobrecargado la capacidad de los gobiernos. Las instituciones públicas están bajo más presión que nunca. La protección de la vida, los medios de vida, el apoyo a los sistemas de salud y la reactivación de la economía hoy son las prioridades más urgentes.
Sin embargo, existe otro asunto que debe atenderse de forma prioritaria: la protección de la gobernanza abierta, incluyente y responsable bajo estándares democráticos y derechos personales.
El estado de emergencia que implica esta pandemia exige la implementación de medidas extraordinarias.
En muchos casos, estas medidas han sido proporcionadas y justificadas. Sin embargo, existen instancias en las que se ha debilitado la supervisión parlamentaria y otros sistemas de control, la eliminación de funcionarios de los órganos de control, censura y presión a periodistas y el despliegue de sistemas de vigilancia digital invasivos y potencialmente permanentes. Muchas intervenciones parecen ir más allá de lo que es necesario para proteger la salud y la seguridad, incluso en el contexto de la pandemia. Y en otros casos, las medidas se han implementado sin tener la claridad de cuándo serán replegadas.
Antes de la pandemia, la democracia ya estaba en riesgo, la confianza en los gobiernos estaba debilitada y el espacio cívico amenazado. Una crisis de esta magnitud amenaza aun más la democracia, lo que se refleja en una mayor represión política, el fortalecimiento excesivo del poder ejecutivo y el aumento de la corrupción.
Sabemos que los gobiernos que reprimen los hechos, que eliminan los sistemas de vigilancia y que silencian a sus críticos pueden escalar las crisis y empeorar las adversidades. Por el contrario, los gobierno abiertos, honestos e incluyentes están aprovechando el conocimiento colectivo para mejorar los servicios públicos y crear un sentido de responsabilidad compartido. Esta visión construye la confianza en las acciones del gobierno y empodera a los ciudadanos a ser participantes activos en la respuesta y la recuperación.
El mundo se encuentra en una encrucijada. Podemos enfrentar esta pandemia implementando medidas que protejan – e incluso revitalicen – la confianza, la democracia y la gobernanza abierta e incluyente. O podríamos ignorar este enfoque, lo que resultaría en un deterioro de la gobernanza abierta muy difícil revertir.
Para promover los valores que definen a la democracia, hacemos un llamado a los gobiernos a:
- Asegurar el papel independiente de los parlamentos. Tomar todas las medidas necesarias para asegurar que los parlamentos sigan operando, que participen y sean consultados sobre las medidas diseñadas para atender la pandemia y que sigan estando en posibilidad de asumir sus funciones de supervisión y control;
- Reforzar la participación y supervisión colaborativas. Establecer mecanismos de participación específicos y sectoriales para aprovechar los conocimientos y experiencia de la sociedad y asegurar la supervisión de las decisiones sobre tratamiento médico, libertades y asignación de recursos y fondos, incluyendo la respuesta inmediata y los paquetes de estímulos;
- Publicar información y datos sobre la situación del coronavirus de forma proactiva. Publicar los datos sobre la situación, modelos analíticos, hallazgos científicos y reportes utilizados para justificar la toma de decisiones. Desarrollar planes de publicación y de datos abiertos para atender las necesidades del público, los medios, la academia y la sociedad civil durante la pandemia.
- Transparentar todas las compras públicas relacionadas con la pandemia. Asegurar que se publique toda la información asociada a las compras de la pandemia, incluyendo las de emergencia, tan pronto como sea posible y de preferencia en un portal centralizado y en formato de datos abiertos. Asegurar que existan datos sobre los registros de las empresas, de manera que los periodistas y órganos de supervisión de la sociedad civil tengan la oportunidad de descubrir posibles casos de fraude o corrupción.
- Permitir que todos los actores puedan dar seguimiento al dinero. Asegurar una mayor transparencia de los fondos públicos con respecto a todas las dimensiones de la respuesta a la pandemia, incluyendo los gastos y paquetes de recuperación. Estructurar debates participativos con todos los sectores de la sociedad y las empresas sobre las medidas económicas identificadas.
- Mantener las leyes de acceso a la información. Implementar medidas específicas para mantener el funcionamiento de las leyes de acceso a la información y respetar los tiempos de respuesta durante la crisis. Cuando la capacidad de los gobiernos esté limitada, dar prioridad a las solicitudes relacionadas con la situación actual, ya sea respondiendo a las solicitudes y/o publicando información de forma proactiva en un sitio web específicamente diseñado para ese fin.
- Garantizar y respetar la libertad de expresión. Defender la libertad de los medios y los derechos de los periodistas de buscar y difundir información, incluyendo la libertad de movimiento de los periodistas. El libre flujo de información, incluyendo en internet, debe ser protegido y las medidas implementadas para luchar contra la difusión de información falsa deberán implementarse sin violentar la libertad de expresión.
- Fortalecer las protecciones a denunciantes. Comprometerse a proteger a quienes presenten denuncias, identificando problemas, escasez, fraudes, y corrupción en las compras públicas y en el uso de los fondos asignados a la respuesta a la pandemia.
- Cuando haya vigilancia, proteger la privacidad. Asegurar que todas las actividades que impliquen la vigilancia o el monitoreo de los ciudadanos para proteger la salud tengan una fecha término definida y que se revisen continuamente, tengan la supervisión de especialistas y la de la sociedad civil para asegurar que protegen la privacidad y que el uso de los datos es totalmente transparente.
- Mantener los procesos de Open Government Partnership. Es absolutamente necesario mantener, en la medida de lo posible, las iniciativas enfocadas en asegurar e impulsar el gobierno abierto. En caso de que exista la necesidad de reestructurar los planes de acción de acuerdo con las prioridades mencionadas aquí, se deberá hacer a través de procesos de consulta con la sociedad civil.
Hacemos un llamado a las organizaciones intergubernamentales a:
- Dar seguimiento y levantar alertas. Es fundamental monitorear los cambios en la gobernanza y en la democracia, así como identificar retrocesos que no respondan de forma proporcional a la crisis.
- Encontrar recursos. Asegurar y movilizar recursos para la implementación de medidas eficaces y ágiles para proteger los derechos humanos y estándares democráticos, incluyendo el espacio cívico, la libertad de expresión y el gobierno abierto.
- Promover el multilateralismo y los mecanismos de colaboración. En la protección de vidas, medios de vida, la democracia y la reconstrucción de la economía, promover al implementación de buenas prácticas que mejoren la vida de los ciudadanos.
Hacemos un llamado a los donantes a:
- Hacer que los fondos hagan la diferencia. Además de responder a las necesidades creadas por la pandemia, fortalecer los esfuerzos dirigidos a proteger los pilares fundamentales de las sociedades abiertas y democráticas. Lo anterior deberá incluir el apoyo a las organizaciones de la sociedad civil y periodistas que trabajan en investigar la transparencia, el derecho al acceso a la información, datos abiertos, libertad de expresión, la anticorrupción y la participación.
Solamente si defendemos y fortalecemos al gobierno abierto durante la respuesta y recuperación de la crisis del COVID-19, podremos revitalizar a la democracia global y promover sociedades más justas, equitativas y cohesivas.

Centrée sur les valeurs démocratiques, la déclaration est un appel à l’action aux gouvernements, aux donateurs et aux organisations internationales. La pandémie de Covid-19 a conduit à un état d’urgence mondial, surchargeant rapidement les gouvernements. Les institutions publiques sont sous pression comme jamais auparavant. La protection des vies et des moyens de subsistance, le soutien des systèmes de santé et le réamorçage de l’économie sont à juste titre devenus les priorités les plus urgentes à traiter dans un avenir immédiat.
Une autre priorité doit se trouver au centre des préoccupations : la protection d’une gouvernance ouverte, inclusive et responsable, avec des normes démocratiques et des droits personnels.
Cette pandémie a mené a un état d’urgence nécessitant des mesures extraordinaires.
Dans de nombreux cas, ces mesures ont été proportionnées et justifiées. Cependant, dans plusieurs cas, il y a eu un affaiblissement du contrôle parlementaire et d’automatismes régulateurs essentiels, la suppression d’importants agents de surveillance, une censure agressive et des pressions sur les journalistes, de même que l’introduction de régimes de surveillance numérique intrusifs et potentiellement permanents. De nombreuses interventions semblent aller au-delà de ce qui est nécessaire pour la santé et la sécurité, même en situation de pandémie. Dans certains cas, des mesures ont été introduites sans aucune précision sur le moment ou la manière dont elles seront diminuées.
Avant la Covid-19, la démocratie était déjà menacée, avec une confiance dans le gouvernement atteignant des niveaux de plus en plus faibles et un espace civique sous attaque. Une crise de cette ampleur menace encore la démocratie par une répression politique accrue, un renforcement trop zélé du pouvoir exécutif et une corruption en hausse.
Nous avons déjà vu que les gouvernements qui étouffent les faits, suppriment la surveillance et réduisent au silence les voix critiques peuvent aggraver les crises et accroître les difficultés. Au contraire, des gouvernements ouverts, honnêtes et inclusifs tirent parti des connaissances collectives pour améliorer les services essentiels et créer un sens des responsabilités partagé. Cette approche nourrit la confiance dans les actions gouvernementales et permet aux citoyens de participer activement à la réponse et à la récupération.
Le monde se trouve à la croisée des chemins. Nous pouvons soit lutter contre cette pandémie d’une manière qui protège ou même qui ravive la confiance, la démocratie et une gouvernance ouverte et inclusive – ou nous pouvons porter des oeillères et nous attendre à une érosion plus profonde de la gouvernance ouverte; il serait alors très difficile de faire marche arrière.
Pour promouvoir les valeurs définissant la démocratie, nous appelons les gouvernements à entreprendre les actions suivantes:
- Assurer le rôle indépendant des parlements. Prendre toutes les mesures possibles pour garantir que les parlements continuent de fonctionner, qu’ils soient engagés et pleinement consultés en matière des décisions concernant la riposte à la pandémie et qu’ils soient pleinement en mesure de remplir leurs fonctions de surveillance et de contrôle;
- Assurer une collaboration et une surveillance participatives. Établir des mécanismes spécifiques, sectoriels et participatifs pour tirer parti de l’expertise de la société et assurer la surveillance des décisions affectant les soins de santé, les droits et libertés, et l’allocation d’urgence des ressources et des fonds, y compris des plans de réponse et de relance à court terme;
- Publier de manière proactive des informations et des données sur la situation du coronavirus. Publier des données circonstancielles, des modèles analytiques, des résultats scientifiques et des rapports utilisés dans la prise de décision et la justification des décisions. Développer une publication proactive spécifique et des plans de données ouvertes pour répondre aux besoins d’information du public, des médias, du monde universitaire et de la société civile au cours de la pandémie.
- Rendre transparents tous les marchés publics d’urgence. Veiller à ce que les informations quant aux achats en cas de pandémie, y compris les approvisionnements d’urgence, soient rendues publiques dès que raisonnablement possible, de préférence sur un portail centralisé et sous forme de données ouvertes. Veiller à ce que les données d’enregistrement des entreprises soient disponibles afin que les journalistes d’investigation et les chiens de garde de la société civile puissent jouer leur rôle en dénonçant fraude et corruption.
- Permettre à toutes les parties prenantes de suivre la trace des fonds publics. Assurer une transparence accrue des fonds publics liés à toutes les dimensions de la réponse à la pandémie, y compris les dépenses et les plans de relance. Structurer le débat participatif avec tous les secteurs de la société et des entreprises en matière de mesures économiques.
- Maintenir les lois sur l’accès à l’information. Prendre des mesures spécifiques pour maintenir le fonctionnement des lois sur l’accès à l’information et les délais de réponse lors de la crise. Lorsque le caractère officiel est limité, hiérarchiser les demandes liées à la situation actuelle, soit en répondant aux demandes et / ou en publiant de manière proactive les réponses aux demandes sur un site Web dédié.
- Garantir et respecter la liberté d’expression. Respecter les libertés des médias et le droit des journalistes de rechercher et de diffuser des informations, incluant la liberté de circulation des journalistes. La libre circulation des informations, y compris sur Internet, doit être protégée et toute mesure visant à lutter contre les fausses informations doit être prise de manière à ne pas limiter la liberté d’expression.
- Renforcer la protection des lanceurs d’alerte. S’engager à protéger les sonneurs d’alerte qui s’expriment dans l’intérêt public pour dénoncer les problèmes, les pénuries, la fraude et la corruption dans les marchés publics et dans l’utilisation des fonds dédiés aux réponses à la pandémie;
- Protéger la confidentialité dans la totalité des suivis. Veiller à ce que tout suivi et surveillance numériques utilisés pour protéger la santé soient limités dans le temps et examinés périodiquement, soient soumis à une surveillance continue de la part de la société civile et des spécialistes afin de protéger la vie privée, et à ce qu’il y ait une transparence totale sur l’utilisation des données.
- Soutenir les processus en cours liés au Partenariat pour un gouvernement ouvert. Il est absolument essentiel de maintenir, dans la mesure du possible, les initiatives en cours pour assurer et faire progresser un gouvernement ouvert. S’il devait s’avérer nécessaire de restructurer les plans d’action conformément aux priorités décrites ci-dessus, cela devrait toujours être fait suite à une consultation complète auprès de la société civile.
Nous appelons les organisations intergouvernementales à :
- Surveiller et mettre en garde. Il est essentiel de suivre les évolutions dans le domaine de la gouvernance et de la démocratie et de signaler les revers disproportionnés par rapport à la crise.
- Trouver les ressources. Assurer et mobiliser des ressources pour garantir des réponses rapides et sans équivoque pour protéger les droits de la personne et les normes démocratiques, y compris l’espace civique, la liberté d’expression et un gouvernement ouvert.
- Poursuivre le multilatéralisme et les mécanismes de collaboration. En ce qui concerne les vies, les moyens de subsistance, la démocratie et la reconstruction économique, commencer une course vers le sommet qui entraînera le plus grand nombre.
Nous appelons les donateurs à :
- Rendre le financement important : Tout en répondant aux besoins créés par la pandémie, redoubler d’efforts pour protéger les piliers fondamentaux des sociétés ouvertes et démocratiques. Cela devrait inclure le soutien aux organisations de la société civile et aux journalistes d’investigation travaillant sur la transparence, le droit d’accès à l’information, les données ouvertes, la liberté d’expression, la lutte contre la corruption et la participation.
Ce n’est qu’en défendant et en renforçant un gouvernement ouvert que nous pourrons revitaliser la démocratie mondiale et créer des sociétés plus justes, égales et cohésives lors de la réponse et de la récupération à la crise de Covid-19.
